The Shield Act

On July 25, 2019, the Stop Hacks and Improve Electronic Data Security Act (SHIELD Act) was signed into law (see Update S5575B). The SHIELD Act expands the definitions of both breach and private information as defined under the NYS Breach Notification Law and requires firms to have controls in place to ensure breach prevention. The Act goes into effect on March 21, 2020. Items in the NYS SHIELD legislation may ultimately be superseded by that more substantial applicable legislation, subject to individual firm registration status and jurisdictions.
